1. Acceptance of Terms

By accessing or using Sorted Car ("the Service") you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, please do not use the Service.

We may update these terms periodically. Continued use of the Service after changes constitutes acceptance of the updated terms.

2. Eligibility

To use Sorted Car you must:

• Be at least 18 years old, OR have parental/guardian consent.
• Be legally able to enter into a binding contract under the law of United States.
• Not be barred from using the Service under applicable law.
• Provide accurate, complete, and current information when registering.

3. Our Services

Sorted Car is a marketplace connecting buyers with verified dealers selling new and used cars. We provide:

• A searchable catalog of car listings.
• Tools to compare cars, calculate EMIs, and contact dealers.
• A blog with car reviews, buying guides, and industry news.
• Dealer onboarding, subscription management, and lead distribution.

Sorted Car is not a party to any transaction between a buyer and a dealer. We don't sell cars directly.

4. Enquiry Terms

When you submit an enquiry through Sorted Car, your contact details are shared with the relevant dealer. The dealer may contact you by phone, SMS, email, or WhatsApp regarding your enquiry.

Sorted Car is not responsible for the content or accuracy of dealer responses, or for any transaction that results. All negotiations and sale agreements are between you and the dealer.

5. Test Drive Policy

Test drives offered through Sorted Car are:

• Subject to dealer availability and approval.
• Conducted at the dealer's location or a mutually agreed point.
• Subject to the dealer's terms (valid driving license, ID proof, etc.).
• Provided at your own risk — Sorted Car is not liable for accidents or damages during a test drive.

6. Listing Accuracy

Dealers are responsible for the accuracy of their listings. While we make reasonable efforts to verify dealers and listings, we cannot guarantee the accuracy of every detail.

Always verify the year, miles driven, registration details, and condition of the car in person before purchase. Ask for the full Title document and service history.

7. Dealer Terms & Subscriptions

If you are a dealer, additional terms apply:

• You must hold valid EIN registration and a physical showroom presence.
• Listings must be accurate, lawful, and free of fraud.
• You must comply with all applicable United States laws regarding motor vehicle sales.
• Subscription fees are non-refundable except where required by law.
• We may suspend or terminate your account for violations of these terms or our policies.

8. Prohibited Activities

You may not:

• Post false, misleading, or fraudulent listings.
• Harvest contact information or scrape the Service without permission.
• Use the Service to harass, defraud, or threaten others.
• Upload malware, viruses, or harmful code.
• Attempt to circumvent our security measures or rate limits.
• Use bots, scripts, or automated tools without our written permission.
• Impersonate another person, dealer, or entity.
• Engage in price manipulation or fake bidding.

9. Limitation of Liability

To the maximum extent permitted by law, Sorted Car and its affiliates, officers, employees, and agents are not liable for:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, or goodwill.
• Disputes between buyers and dealers, or the quality of any vehicle.
• Any matter beyond our reasonable control (force majeure).

Our total liability for any claim related to the Service is limited to the amount you've paid to Sorted Car in the 12 months before the claim arose, or $10.0K, whichever is less.

10. Intellectual Property

All content on Sorted Car — including logos, designs, text, code, and blog articles — is owned by Sorted Car or licensed to us. You may not copy, modify, distribute, or create derivative works without our written permission.

Listings and photos you upload remain your property, but you grant Sorted Car a worldwide, royalty-free, non-exclusive license to display, distribute, and promote them through the Service.

11. Governing Law

These Terms are governed by the laws of United States. Any dispute arising from or related to these Terms or the Service will be subject to the exclusive jurisdiction of the courts at New York.
